Equipment Rental and Liability Release Agreement:

I understand that the binding system cannot guarantee the user's safety. In downhill skiing, the binding system will not release at all times or under all circumstances where release may prevent injury or death, nor is it possible to predict every situation in which it will release. In snowboarding, the binding system will not ordinarily release during use; these bindings are not designed to release as a result of forces generated during ordinary operation.

Helmets are recommended: Helmets protect your head, but they don't prevent all injuries, especially from high-speed impacts or collisons with obstacles. Always ski within your abilty, stay alert, and follow safety guidelines. It's important to understand that helmets are far less effectie at higher rates of speed. Remember that helmets are just one part of staying safe on the slopes. 

I understand that the sports of skiing and snowboarding involve inherent risk of injury and death. I voluntarily agree to expressly assume all risk which may result from the use of this equipment.

I agree to release Michigan Technological University, Mont Ripley, employees, owners, affiliates, agents, officers, directors, and the manufacturers and distributors of this equipment ("Providers") from all liability for injury, death, property loss, and damage which results the the equipment user's participation in the sport of skiing or snowboarding, or is in anyway related to the use of this equipment including all liability with results from the negligence of the Provider or any person or cause.

I further agree to defend and indemnify Providers for any loss or damage, including any that results from claims or lawsuits for personal injury, death, property loss, and damage related in any way to the use of this equipment.

This agreement is governed by the applicable law of this state. If any provision of this agreement is determined to be unenforceable, all other provisions shall be given full force and effect.

I accept for use AS IS the equipment requested herein, and accept full financial responsibility for the care of the equipment while it is in my possession. I agree to return all equipment on the agreed upon date/time, regardless of condition. I will be responsible for the full replacement value of any equipment rented herein but not returned to the rental shop or damaged beyond reasonable repair.

I agree to pay Mont Ripley's charge of $400.00 for a deposit and understand that full or partial deposits will be returned after inspection of the returned equipment and that full deposits will be forfieted for damages beyond repair. I further understand that failure to return equipment will result in legal action.

Prices shown in cart do not include tax. Tax will be added to the final cost of all rentals.

Cancellation Policy: Full deposit will be refunded if reservation is cancelled more than 48 hours in advance. Rental reservations cancelled less than 48 hours in advance will receive a deposit refund minus one day rental fee ($75.00)
